TERROR IN THE NEW YEAR—TRUMP’S JOB ONE IS CLEAR
INTRODUCTION
My plan was to write yet another take on 2024 as the year the rule of law and due process were sacrificed at the altar of political expediency. I woke up to the carnage and terror of the New Orleans truck attack, and a short time ago, the explosion of a fireworks-laden Cybertruck outside of a Trump International building in Las Vegas. My mission changed. Interestingly, both trucks were rented and were electric. I assume, if the events are related, this was to ensure they would keep burning beyond that which one would see in a conventional vehicle. At least in the New Orleans incident, the in-vehicle IED was probably supposed to ignite the battery cells and cause an extended distraction and further chaos. Was this all not discoverable ahead of time? We will see in the new Administration.
The American people should be outraged at the dismantling of this country by Joe Biden and his band of freaks. I am supposed to use measured language as a member of the Bars of both federal and state courts, but I cannot. This brief article will focus on what went wrong and what LEGALLY can be done and has not been done by the most ineffective and feckless President in United States history. But for the immunity granted to the Chief Executive by the Supreme Court, a decision that I support for the ages, Biden could be tried for misfeasance and/ or impeached. His naked pandering to a base that has been cast into the irrelevant wilderness has cost countless lives and civil order.
WHAT WENT WRONG
In the aftermath of the January 6th riot, the federal law enforcement apparatus of this country was tasked with chasing over one thousand citizens who were identified as having some connection to this event. Using all manner of sophisticated techniques that should have been utilized tracking actual terrorists and criminals, federal agents swooped in on scores of people who were let in to the Capitol by the police and wandered around taking pictures. Lives were ruined, and some ended in suicide, including some Capitol police personnel, for reasons we may never know. Pelosi and company saw a grand opportunity to end Trump with an emphasis on these prosecutions, the canard that he incited it, and the detailing of hundreds of agents to hunt down the wrong people. Given the Presidency by squeaking past Sanders in the primaries thanks to Rep. Clyburn (who still thinks it is 1964 and got Biden out of South Carolina), Biden repaid the favor by declaring that public enemy number 1 was:
- “White Supremacists”, who, according to Biden and Hollywood, are those who support law and order and the horrific notion of making America great again. In reality, the FBI could not find any real threat from these folks and wound up entrapping a bunch of knuckleheads in Michigan who were going to “kidnap” Gov. Whitmer. Didn’t see any burning down of cities and rioting from these folks in recent years. Have you? Any prosecutions of those folks?
- Christians who protested at abortion clinics—how dare they!
- Parents who demanded that fake teachers stop tampering with their children through indoctrination and the fiction that biological boys posed no threat to girls in school bathrooms when such boys declared that they were in fact girls. Not to mention that the rights of parents to raise their children are the most sacred of fundamental rights, according to the Supreme Court.
While all of this bald, baseless political pandering was going on so the lunatic left would not throw a tantrum, the Biden freak show was honing their craft of working around existing immigration law to undo the security that Orange Man Bad gave all of us at the border. The real Public Enemies are Alejandro Mayorkas, Merrick Garland, and of course, Joseph Biden. Millions of improperly vetted migrants, scores of whom undoubtedly bore this country ill will, crashed into the southern border and fanned out to plan mischief or await orders from their handlers in the intelligence services of our geopolitical foes. Was the FBI, tasked with internal enforcement of counterterror methods, watching the store? No.
NEW ORLEANS IS THE TIP OF THE ICEBERG
It is clear that Shamsud -Din Jabbar was a U.S. Army veteran and also a U.S. citizen. It is also clear that he did not act alone. Were the other actors citizens? Gotaways? Potential Islamic terror has been an ongoing threat for years, and the environment for a reformulated ISIS, Al-Qaeda, or any similar organization or destructive cell has intensified given the recent events in the Middle East, the chaos in Syria and Libya, and the fading yet continued contribution of Iran to anti-American and anti-Israel efforts. The FBI has declared that this was an act of terror and that it is likely there were others in a probable cell. IEDs were found in the vehicle and in the French Quarter, and more carnage might have followed. The FBI under a Trump administration will tell us whether this miscreant was on their radar and whether it could have been prevented. Make no mistake, under Garland, Mayorkas, and Biden, the “politics” simply did not support aggressive efforts targeting Muslim extremism. It was, for Biden, better to please BLM by continuing to try to find those pesky and elusive terrorist extreme MAGAs and “white supremacists.” These decisions have killed Americans and seeded much ill will among us. Fifteen dead in New Orleans, and tragically there will probably be more. Kash Patel cannot be confirmed quickly enough. The same for Pam Bondi. Kristi Noem and Tom Homan to follow. It is time that the law be used to protect Americans, not place them in harm’s way. Biden’s disgraceful and intentional misdirection of precious federal law enforcement assets will take years to fix. Trump needs to start on day ONE—here is how.
EXISTING LAW HAS TO BE UTILIZED TO CLOSE THE BORDER SO WE CAN GET A HANDLE ON THE DAMAGE WROUGHT BY BIDEN—OH YES—AND HARRIS TOO
It should come as no surprise that Congress has provided the Executive Branch ample tools to protect the American public. 19 U.S.C. Section 1318 (b)(2) provides:
“The Commissioner of U.S. Customs and Border Protection , when necessary to respond to a specific threat to human life or national interests, is authorized to close temporarily any Customs office or port of entry or take any other action that may be necessary to respond to the specific threat.”
The Secretary of Homeland Security is responsible for securing the borders and the ports, territorial waterways, as well as all air, land, and sea transportation systems of the United States. Mayorkas has not done this and has allowed alternatives to detention not permitted in the manner he has dispensed such alternatives, namely the abuse of parole “discretion.” Criminal immigrants have rooted themselves in cities large and small and will take millions of dollars to remove and prosecute. They were never vetted to begin with.
Related provisions of the U.S. Code provide for the Secretary FULL authority to guard the boundaries and borders from the exploitation of those who seek to enter illegally. See 8 U.S.C. Section 1103.
TRUMP HIMSELF HAS FULL AUTHORITY AS PRESIDENT TO CLOSE THE BORDER TO PREVENT CRIMINALS, TERRORISTS, AND OTHERS FROM ENTRY—PERIOD.
The wisdom of most of the Americans who voted for Trump cannot be overstated. They knew that he learned how to govern in his first term, that he was hindered by corruption within the deep state and the legacy media, and, most probably, that he was the victim of a rigged election regardless of the presence of actual fraud. His loyal advisors, however, guided him through the role of the Executive in immigration enforcement, and he scored a major victory in Trump v. Hawaii, 585 US 667 (2018), when the Supreme Court upheld his Proclamation 9645, a detailed analysis and policy that led to the denial of admission and visas to a select list of nationals from designated countries who failed to provide sufficient information to US immigration officials to do a threat and risk assessment. President Trump stated at Section 1 of that Proclamation:
“…It is the policy of the United States to protect its citizens from terrorist attacks and other public safety threats. Screening and vetting protocols and procedures associated with visa adjudications and other immigration processes play a critical role in implementing that policy. They enhance our ability to detect foreign nationals who may commit, aid, or support acts of terrorism or otherwise pose a safety threat…”
The Supreme Court, over the objections of open border virtue signalers, upheld Trump’s order, which limited or excluded visas or entry from the countries of Chad, Iran, Syria, North Korea, Venezuela, and Yemen. Specifically, the Court found that 8 U.S.C. Section 1182 (f) required them to give deference to any President’s findings as Chief Executive charged with faithfully executing the laws. In fact, the late President Jimmy Carter used the statute to ban certain Iranian immigrants as well as the issuance of visas during the hostage crisis. The provision states:
“Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may, by proclamation, and for such period as he shall deem necessary, SUSPEND THE ENTRY OF ALL ALIENS OR ANY CLASS OF ALIENS AS IMMIGRANTS OR NONIMMIGRANTS OR IMPOSE ON THE ENTRY OF ALIENS ANY RESTRICTIONS THAT HE MAY DEEM TO BE APPROPRIATE.”
(Emphasis mine).
Whether a terrorist or criminal from any country, Trump 2.0 can fine-tune any future Proclamation and stop the ingress of the unknown. Note that Venezuela was specifically targeted because then and as now there was little to no vetting information provided as Maduro wanted to empty his jails. Biden took the bait. Trump will not. On his first few days in Office Trump needs to reissue his Proclamation and broaden its reach. Any challenge will fail. It is time that we knew just how ineffective the FBI and our internal security apparatus have been while chasing January 6th participants and phoning it in on the real threats to our safety and our ordered liberty.
CONCLUSION
Senator John Kennedy will not leave a stone unturned given this violence perpetrated in his beloved Louisiana. He will provide the answers and get them whatever it takes. The incoming Administration must focus on the real harms, not the political harms. At no time in our recent history has ordered liberty been as threatened as it has been under Biden. Unconstitutional pandemic workarounds destroying liberty, open borders, the invitation to criminals and terrorists to come into this country unvetted, and, finally, the misallocation of resources to chase the wrong people. All for politics. If you are not outraged, you should be. January 20th cannot come soon enough.
